SMS Terms & Messaging Policy

This SMS Terms & Messaging Policy (the "Policy") describes the text message (SMS) program operated by KAKEL ENTERPRISES LLC on behalf of PesaNet Inc (collectively, "PesaNet", "we", "our", or "us"). It supplements our Terms of Service and Privacy Policy and applies to anyone who provides PesaNet with a mobile phone number through the PesaNet mobile application or website.

1. Program Name and Purpose

Program name: PesaNet Verification & Security Messages.

PesaNet is a regulated mobile financial services platform. The SMS program is used exclusively to deliver transactional security codes that confirm an action you have explicitly initiated inside the PesaNet app. We do not send marketing, promotional, or recurring messages through this program.

2. Types of Messages You May Receive

If you provide your mobile number to PesaNet, you may receive the following message types:

  • Signup verification: a one-time code sent when you register a new PesaNet account.
  • PIN reset: a one-time code sent when you tap "Forgot PIN" inside the app.
  • Withdrawal & transfer confirmation: a one-time code sent when you confirm a cash-out, mobile-money withdrawal, or external transfer above PesaNet's risk threshold.

Example messages (codes shown are illustrative):

Your PesaNet verification code is: 123456. It expires in 15 minutes.

Your PesaNet PIN reset code is: 123456. It expires in 10 minutes. If you didn't request this, ignore this message.

Your PesaNet withdrawal code is 123456. Enter it to confirm your Lumicash withdrawal. Expires in 10 minutes.

3. How You Consent (Call to Action)

You opt in to this SMS program at the moment you enter your phone number in the PesaNet mobile app and tap "Continue." Directly above the Continue button, the PesaNet app displays the following disclosure verbatim:

By continuing, you agree to our Terms of Service, Privacy Policy, and SMS Terms, and consent to receive SMS verification and security codes from PesaNet. Message and data rates may apply. Message frequency varies by your account activity. Reply HELP for help or STOP to opt out.

No SMS is sent until you take this explicit action. We do not pre-check the disclosure, and we do not import phone numbers from any third-party list.

For PIN-reset and withdrawal-confirmation codes, the same consent applies; each individual message is triggered by a further explicit in-app action you take (tapping "Forgot PIN" or confirming a withdrawal amount).

4. Message Frequency

Message frequency is per user-initiated action only. We do not send recurring, scheduled, drip, or marketing messages. A typical PesaNet user receives between 0 and 5 verification messages per month, depending on how often they sign in on a new device, reset their PIN, or initiate a withdrawal. Inactive users receive zero messages.

5. Cost

PesaNet does not charge you for these messages. Message and data rates may applydepending on your mobile carrier and plan. Contact your mobile carrier for details about your messaging plan and any associated costs.

6. Opt-Out (STOP)

You may opt out of the SMS program at any time by replying with any of the following keywords to a message from PesaNet:

  • STOP
  • STOPALL
  • UNSUBSCRIBE
  • CANCEL
  • END
  • QUIT
  • REVOKE
  • OPTOUT

After you opt out, you will receive a single confirmation message:

You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe.

Once you opt out, PesaNet will not be able to send you SMS verification codes. You will need to either resubscribe (reply START) or use an alternate verification method (such as email) to complete signup, PIN reset, or withdrawal confirmation. Some account features may be unavailable while you are opted out.

7. Help (HELP)

For support, reply HELP or INFO to any PesaNet message. You will receive the following auto-response:

Reply STOP to unsubscribe. Msg&Data Rates May Apply.

8. Carrier Disclaimer

PesaNet's SMS messages are delivered via U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers include (but are not limited to) AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, and Virgin Mobile.

9. Eligibility and Age

You must be at least 18 years old and the authorized user or subscriber of the mobile number you provide. By providing your number, you represent that you meet these requirements.

10. Privacy

We treat your phone number and the contents of verification messages as personal data under our Privacy Policy. We do not sell or share your phone number with third parties for marketing purposes. Verification codes are processed by our SMS aggregator (Twilio Inc., Messaging Service SID MG62ef636d6358a66ce78249661412d5d4) solely to deliver the message to your carrier.

11. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be communicated via in-app notification or by SMS, where appropriate.
